Terms and Conditions – Whisker and Wishes (English Version)

Welcome to Whisker and Wishes.

By accessing our website, purchasing a physical or digital product, or
booking any of our services, you agree to the following Terms and Conditions. These terms constitute a
legally binding agreement between you (the “client” or “user”) and Whisker and Wishes.

1. Purpose
Whisker and Wishes provides:

• Physical products (decorations, accessories, pet-related items).

• Digital products (ebooks, guides, recreational and informational materials).

• On-site services (pet-themed parties, photography, decoration, logistics, and cleaning).

2. Product use

• All physical products are intended exclusively for decorative or recreational purposes, unless expressly stated otherwise.

• They are not toys or food and must not be ingested by pets, children, or adults.

• Customers are solely responsible for ensuring safe and supervised use of all products.

• Whisker and Wishes shall not be held liable for poisoning, choking, allergic reactions,
injuries, illness, health damage, or death resulting from ingestion, improper handling, or misuse of products.

3. Customer responsibility

• Customers are solely responsible for supervising their pets, young children, and guests when using products or attending events organized by Whisker and Wishes.

• Customers acknowledge and accept the inherent risks of interacting with animals and children, as well as attending social events, and assume such risks entirely.

4. Digital products

• Digital content (ebooks, guides, informational materials) is for personal, non-transferable, and
non-commercial use only.

• Reproduction, distribution, resale, lending, or exploitation without written consent is strictly prohibited.

• Digital products are informational and recreational and do not replace veterinary, medical, legal, or professional advice.

• Digital purchases are non-refundable.

5. Payments
• All payments are processed via Square, under its own security terms.

• Customers must ensure payment details are accurate and authorized.

6. Shipping

• Shipping is available only within Australia.

• Shipping costs are covered by the customer, except for purchases above AUD $150, which qualify for free shipping.

• Whisker and Wishes is not responsible for delays, loss, theft, errors, or damage caused by the courier company.

7. Returns and refunds
• Physical products: returns are accepted only for factory defects or verifiable damage not attributable to the courier.

• Customers must notify within [X days] of receiving the product.

• Returns will not be accepted for misuse, normal wear and tear, negligence, or accidents.

• Events and services:
o Cancellations and refunds are only accepted within the deadlines specified at booking.
o If Whisker and Wishes cancels, customers will receive a full refund plus a
complimentary gift.

o For extreme weather conditions, customers may choose to reschedule, move to a
covered area, or cancel with no penalty to either party.

8. On-site services and events

• By booking any event or service, customers confirm they have read and accepted these Terms and Conditions.

• Whisker and Wishes shall not be liable for:
o Accidents, injuries, losses, or deaths of pets, children, or adults during the event.
o Damage to private property where the event is held.

o Damages caused by animals or persons present at the event.
• Customers are responsible for providing a safe environment.

9. Health, allergies, and emergencies

• Customers must inform Whisker and Wishes in advance of any allergies, medical conditions, or
special requirements of their pets or guests.

• Whisker and Wishes shall not be held responsible for adverse reactions to food, decorations,
materials, or products used during events or delivered.

• Customers are responsible for seeking veterinary or medical supervision if deemed necessary.

10. Limitation of liability

• Whisker and Wishes’ total liability shall be strictly limited to the total amount paid by the
customer for the relevant transaction.

• We shall not be liable for indirect losses, lost profits, medical expenses, emotional distress, moral damages, or consequences resulting from the use of products or services.

11. Intellectual property

• The name Whisker and Wishes, our logos, designs, photographs, digital materials, and all other content are the exclusive property of the company.

• Any unauthorized use, copying, imitation, or distribution is strictly prohibited.

12. Force majeure

• Whisker and Wishes shall not be held responsible for non-performance caused by
circumstances beyond our reasonable control, including natural disasters, pandemics, strikes, blackouts, government actions, technological failures, or weather conditions.

13. Governing law

• These Terms and Conditions are governed by the laws of Australia, specifically the Australian Consumer Law (ACL).

• Any disputes shall be subject to the jurisdiction of the competent courts in Australia.

14. Amendments

• Whisker and Wishes reserves the right to amend these Terms and Conditions at any time.

• Amendments will be effective immediately upon publication on our website.
